AGREEMENT Accommodation Terms and Conditions

Scope of application

Article 1

  1. Accommodation contracts and related contracts entered into by our hotel with guests shall be as stipulated in these terms and conditions, and matters not stipulated in these terms and conditions shall be governed by laws and regulations or generally established customs. Masu.
  2. If the Hotel accepts a special agreement to the extent that it does not violate laws and customs, that special agreement shall take precedence, notwithstanding the provisions of the preceding paragraph.

Application for accommodation contract

Article 2

  1. A person who wishes to apply for an accommodation contract with this hotel must provide the following information to the hotel.
    1. Guest name
    2. Accommodation date and estimated time of arrival
    3. Accommodation charges (as a general rule, according to the basic accommodation charges in attached table 1)
    4. If you are a minor staying alone, you will need to submit a consent form signed by a parent or guardian.
    5. Other matters deemed necessary by the hotel
  2. If the hotel requests the submission of a guest list containing the names, addresses, telephone numbers, etc. of guests, those who have applied for accommodation shall submit it immediately even after the accommodation contract has been concluded. .
  3. The hotel may call the guest on any day prior to the scheduled stay to confirm the reservation using the contact information provided by the guest.
  4. If a guest requests to continue staying beyond the accommodation date specified in item 2 of the preceding paragraph during their stay, the hotel will treat the request as having been applied for a new accommodation contract at the time the request is made. .

Establishment of accommodation contract, etc.

Article 3

  1. The accommodation contract shall be concluded when the hotel accepts the application set forth in the preceding article. However, this does not apply if the applicant proves that the hotel has not given consent.
  2. When an accommodation contract is concluded pursuant to the provisions of the preceding paragraph, the application fee determined by the hotel, which is limited to the basic accommodation fee for the period of stay, shall be paid by the date specified by the hotel.
  3. The application fee will first be applied to the accommodation fee that the guest will ultimately have to pay, and in the event that the provisions of Articles 6 and 17 apply, the application fee will be applied to the cancellation fee and then to the compensation. If there is any remaining amount, it will be returned at the time of payment of fees pursuant to Article 12.
  4. If the application fee set forth in Paragraph 2 is not paid by the date specified by the Hotel pursuant to the provisions of the same paragraph, the Accommodation Contract shall become invalid. However, this only applies if the hotel notifies the guest of this fact when specifying the due date for payment of the application deposit.

Special agreement that does not require payment of application fee

Article 4

  1. Notwithstanding the provisions of Paragraph 2 of the preceding article, the Hotel may accept a special agreement in which the payment of the application fee set forth in the same paragraph is not required after the conclusion of the contract.
  2. When accepting an application for an accommodation contract, if the hotel does not request the payment of the application fee set forth in Paragraph 2 of the preceding article or does not specify the payment date for the application deposit, it will be treated as acceptance of the special agreement set forth in the preceding paragraph. Refusal to conclude an accommodation contract

Article 5

  1. The hotel may not accept the conclusion of an accommodation contract in the following cases.
    1. When the application for accommodation does not comply with these terms and conditions.
    2. When there are no rooms available due to full occupancy.
    3. When it is deemed that there is a risk that the person seeking accommodation may engage in acts that violate the provisions of laws and regulations, public order, or good morals regarding accommodation.
    4. When it is deemed that there is a risk of disrupting the peace and order of the Hotel, such as when a person seeking accommodation has made a complaint or request without reasonable grounds within the Hotel.
    5. When the person seeking accommodation is deemed to fall under any of the following (a) to (d).

    6. (a) Designated organized crime groups and designated organized crime members, etc. (hereinafter referred to as "organized crime groups" and "organized crime group members") as stipulated in the Act on Prevention of Unjust Acts by Organized Crime Group Members (enacted on March 1, 1992), and their related persons. When the person is a quasi-member of an organized crime group or other anti-social forces.
      (b) When an organized crime group or organized crime group member is a corporation or other organization that controls business activities.
      (c) A corporation that has one of its officers who is a member of an organized crime group.
      (2) Anti-social organizations, members of anti-social organizations, and their related persons.
    7. When a person intending to stay overnight engages in behavior that causes significant inconvenience to other guests.
    8. When the person seeking accommodation is clearly recognized as having a contagious disease.
    9. When a person intending to stay overnight engages in behavior that causes a nuisance to other guests during their stay, such as by singing, making noise, singing, dancing, or making music.
    10. When the person seeking accommodation is clearly found to be unable to pay.
    11. When the person attempting to stay overnight is deemed to be acting suspiciously.
    12. When violent demands are made regarding accommodation or a burden that exceeds a reasonable range is demanded.
    13. When accommodation is not possible due to natural disasters, facility failures, or other unavoidable reasons.
    14. When the person attempting to stay overnight is deemed to be inebriated and likely to cause a significant nuisance to other guests. Or when a guest engages in behavior that significantly annoys other guests. (Based on the provisions of Article 6 of the Sasebo City Hotel Business Law Enforcement Ordinance.)
    15. When a person who applied for accommodation did so while concealing his or her commercial purpose.

Guest's right to cancel the contract

Article 6

  1. The guest can cancel the accommodation contract by notifying the hotel.
  2. In the event that the Guest cancels all or part of the accommodation contract due to reasons attributable to the Guest (as per the provisions of Article 3, Paragraph 2), the Hotel shall specify the due date for the payment of the application fee. (excluding cases where the Guest cancels the Accommodation Contract before the payment is made), the Guest will be charged a penalty as listed in Appendix 2 of Article 20. However, if our hotel accepts a special agreement under Article 4, Paragraph 1, when accepting the special agreement, we will notify the guest of the obligation to pay a penalty fee when the guest cancels the accommodation contract. Only when notified.
  3. In the case when the Guest does not arrive by 24:00 (or time elapsed before the estimated time of arrival if the Guest has been notified of the Hotel) without prior notice, the Hotel may regard the Accommodation Contract as being cancelled by the Guest.

Our hotel's right to cancel the contract

Article 7

  1. The hotel may cancel the accommodation contract in the following cases.
    1. When the Guest is deemed to be at risk of committing an act that violates the provisions of laws and regulations, public order, or good morals regarding accommodation, or when it is recognized that the Guest has committed the same act.
    2. When the Guest is deemed to be disturbing the peace and order within the Hotel, such as by making complaints or demands without reasonable grounds within the Hotel.
    3. When the Guest is deemed to fall under any of the following A to C:
      (b) Organized crime groups, organized crime group members, organized crime group associate members, organized crime group related persons, and other anti-social forces.
      (b) When the organized crime group or organized crime group member is a corporation or other organization that controls business activities.
      (c) A corporation that has one of its officers who is a member of an organized crime group.
    4. When a guest engages in behavior that causes significant inconvenience to other guests.
    5. When a guest is clearly recognized as having a contagious disease.
    6. When violent demands are made regarding accommodation or a burden that exceeds a reasonable range is demanded.
    7. When accommodation is not possible due to reasons caused by force majeure such as natural disasters.
    8. When the person attempting to stay overnight is deemed to be inebriated, etc. and is likely to cause a significant nuisance to other guests. Or when a guest engages in behavior that significantly annoys other guests. (Based on the provisions of Article 6 of the Nagasaki Prefecture Hotel Business Law Enforcement Ordinance.)
    9. When smoking outside of the designated areas, tampering with fire equipment, etc., or otherwise failing to comply with the prohibited matters stipulated in the "Rules of Use" stipulated in these Terms and Conditions.
    10. When the person who applied for accommodation does not immediately respond to the request of the hotel pursuant to Article 2, Paragraph 2.
  2. When the hotel cancels the accommodation contract based on the provisions of the preceding paragraph, and the reason for the cancellation is item 7 of the preceding paragraph, fees for accommodation services, etc. that the guest has not yet received will be refunded. If the cancellation is due to other reasons, fees for accommodation services, etc. that have not yet been provided will be charged as a penalty and will not be refunded.

Registration of accommodation

Article 8

  1. Guests must register the following information at the front desk of our hotel on the day of their stay.
    1. Guest's name, address, phone number
    2. For foreigners, nationality and passport number
    3. Check and copy your passport or take SCAN data
    4. Other matters deemed necessary by the hotel
  2. If the Guest intends to pay the charges set forth in Article 12 using a method that can be substituted for currency, such as a traveler's check, accommodation voucher, or credit card, the Guest must present these in advance at the time of registration as set forth in the preceding paragraph.

Room usage time

Article 9

  1. Guests time use the hotel's guest rooms from 3:00 p.m. to 11:00 a.m. the following morning. However, if you stay for consecutive nights, you can use it all day except for the day of arrival and the day of departure.
  2. Notwithstanding the provisions of the preceding paragraph, the hotel may accept guest rooms for use outside of time specified in the same paragraph. In this case, the following additional charges will be charged.
    1. Late check-out is available up to 2pm. The additional charge is ¥1,000 per person per time.
    2. After 2:00 p.m., in addition to the additional charges listed in the preceding paragraph, the accommodation fee for one room and one night on the day of check-out will be charged.
    3. Early check-in will be counted for time you start using the room before 3:00 pm, and the additional charge will be 1,000 yen per person per time.
      *A fee will be charged for each person using the bed.
      *Depending on the situation on the day, we may not be able to accept your request.

Compliance with usage rules

Article 10

Guests must comply with the "Rules of Use" set forth in these Terms and Conditions while inside the Hotel.

Payment of fees

Article 11

  1. The details of the accommodation charges, etc. to be paid by the Guest are as listed in Attached Table 1.
  2. Payment of the accommodation charges, etc. as set forth in the preceding paragraph shall be made in Japanese currency or by alternative methods recognized by the Hotel, such as traveler's checks, accommodation vouchers, credit cards, etc., at the time of the Guest's check-in or when requested by the Hotel.   3. Even if the guest does not voluntarily stay after the hotel has provided the guest room and made it available, the accommodation fee will be charged.

Our hotel's responsibilities

Article 12

  1. The Hotel will compensate the Guest for any damage caused to the Guest in the performance of the Accommodation Contract and related contracts, or in the event of non-fulfillment thereof. However, this does not apply if the damage is not due to reasons attributable to the hotel.
  2. The hotel's responsibility for accommodation begins when the guest registers for accommodation at the front desk of the hotel and ends when the guest completes the check-out procedure.
  3. Our hotel has liability insurance to deal with the unlikely event of a fire, etc.

Handling when the contracted room cannot be provided

Article 13

  1. If the hotel is unable to provide the guest with the contracted room, the hotel will, with the guest's consent, arrange for accommodation at another accommodation facility with the same conditions as possible.
  2. If the hotel is unable to arrange other accommodations despite the provisions of the preceding paragraph, the hotel will pay the guest a compensation fee equivalent to the penalty, and the compensation fee will be applied to the amount of damages. However, if there is no reason attributable to the hotel for the inability to provide a guest room, no compensation fee will be paid.

Handling of deposited items, etc.

Article 14

  1. We do not accept cash, valuables, artwork, antiques, fragile items, liquids, perishables, pets, or other items.
  2. In the event that damage such as loss, loss, or damage occurs to items left at the front desk by the guest, the hotel will compensate for the damage, unless the damage is caused by force majeure. However, if the Hotel requests a declaration of the type and value and the Guest fails to do so, the Hotel will compensate for the damage up to 30,000 yen.
  3. Any scratches or dents on luggage left by guests in the smart cloakroom, coin lockers, or lobby are not covered by the warranty.

Storage of guests' baggage or personal effects

Article 15

  1. If the guest's baggage arrives at the hotel prior to his or her stay, the hotel will take responsibility for storing the baggage and hand it over to the guest when checking in at the front desk only if the hotel agrees to do so prior to the guest's arrival.
  2. If the guest's baggage or personal effects are left behind at the hotel after the guest has checked out, and the owner is identified, the hotel will contact the owner and provide instructions. I shall ask for it. However, if there is no instruction from the owner or if the owner is unknown, the following shall be handled to the extent permitted by law.
    1. Cash and valuables: After being stored at our hotel for 7 days including the date of discovery, we will deliver it to the nearest police station.
    2. Perishable foods: Regardless of price or expiry date, they will be disposed of on the same day they are discovered.
    3. Other properties: After being stored at our hotel for 3 months including the date of discovery, it will be disposed of in accordance with the Lost Property Act.
  3. In order to dispose of left behind baggage or personal effects appropriately according to the nature of the contents, the Hotel will voluntarily check the contents and, if necessary, return them to the owner or dispose of them in accordance with the preceding paragraph. The Guest may not object to this.
  4. The hotel's responsibility for the storage of the guest's baggage or personal effects in the cases of Paragraphs 1 and 2 shall be as specified in Paragraph 1 of the preceding Article in the case of Paragraph 1, and as per the provisions of Paragraph 1 of the preceding Article in the case of Paragraph 1. shall comply with the provisions of Paragraph 2 of the same article.

Parking responsibilities

Article 16

If a guest uses the hotel's parking lot and the hotel manages the parking lot and causes damage due to intentional or negligent behavior on the part of the hotel, the hotel will be responsible for compensation.

Guest responsibilities

Article 17

  1. If the Hotel suffers damage due to the intentional or negligent act of the Guest, the Guest shall compensate the Hotel for the damage.
  2. In order to smoothly receive the accommodation services based on the accommodation contract, if the guest becomes aware that accommodation services that differ from the contents of the accommodation contract have been provided, the guest must promptly notify the hotel to that effect. not.
  3. All areas of our hotel facilities (except designated smoking areas) are non-smoking, so if smoking is confirmed in the guest room or facility, the guest will be charged the guest room cleaning fee due to smoking and damages for the termination of guest room sales as listed in Attachment 3. .
    *If cigarette butts are found in the guest room, it will be considered smoking.

Disclaimer

Article 18

The use of computer communications from within the hotel is at guests own risk. The hotel will not be held responsible for any damages sustained by the user as a result of interruption of service due to system failure or other reasons while using computer communications. In addition, in the event that the Hotel or a third party suffers damage due to conduct that the Company deems inappropriate when using computer communications, the Hotel will be required to compensate for such damage.

Refusal to continue use

Article 19

The hotel may refuse continued use in the following cases.

  1. When an undesirable act has been committed towards the Hotel, or when it is recognized that there is a risk of such an act being committed.
  2. When this agreement is violated (including cases where the hotel determines that there is a risk of violation).

Jurisdiction and governing law

Article 20

Disputes regarding accommodation contracts between our hotel and guests shall be governed by Japanese law, and the court with jurisdiction over the domicile or head office of the party against whom the lawsuit is filed shall have exclusive jurisdiction.

Rules of use

In order to ensure a safe and comfortable stay for guests, our hotel has established the following usage rules based on Article 10 of the Accommodation Terms and Conditions, and we ask for your cooperation. If you do not comply with these usage rules, we may be forced to refuse your stay and use of the hotel's facilities pursuant to Article 7, Paragraph 1 of the Accommodation Terms and Conditions, and you may be required to bear any damages incurred by the hotel. Thank you for your understanding.

■About safety and disaster prevention precautions

  1. When leaving your room during your stay, please make sure to lock the door (our hotel locks automatically).
  2. Please check the evacuation route map displayed inside each guest room door.
  3. Please refrain from meeting with visitors in your guest room.
  4. Please do not use the guest room for any purpose other than lodging without permission.
  5. If you are only staying under the age of 18, you will need to submit a consent form signed by a parent or guardian.
  6. Please do not use appliances that generate heat such as heating or cooking appliances in the guest room, or electric appliances such as irons that are not specified by the hotel.
  7. Smoking is prohibited inside the building, including guest rooms and the lobby.Please do not smoke outside the building except in designated areas.
  8. Please do not use items that may cause a fire, such as fireworks, incense sticks, candles, etc., or items that leave a strong odor.

 

■About valuables

Please use the safe deposit box provided in your room to store your cash and valuables.

■About payment

We do not accept advance payment for ticket costs for airplanes, trains, sightseeing buses, etc., taxi fares, postage stamp costs, luggage shipping, etc.

■We do not allow the following items into our hotel facilities.

  1. Animals and other pets. (Excluding assistance dogs)
    Please let us know in advance if you will be bringing your assistance dog.
  2. Poisonous substances, toxic chemical agents, and substances that emit extremely foul odors and smoke.
  3. Firearms, swords, gambling equipment, and other criminal property, and property prohibited by law.
  4. Explosive, ignitable, or flammable materials such as gunpowder, volatile oil, etc.
  5. Something that makes noise.
  6. Other properties that are deemed to pose a threat to the safety of other guests.

■The following acts are prohibited within our hotel facilities.

  1. Acts that violate criminal laws and regulations, such as gambling and other acts that violate public morals.
  2. Acts of political activities, election campaigns, and religious activities.
  3. Acts such as selling goods, advertising, donations, signatures, etc.
  4. Acts such as filming and recording using cameras, videos, and any other equipment for commercial purposes without permission.
  5. The act of bringing food and drink into a restaurant and eating and drinking.
  6. The act of bringing food into a restaurant and asking an employee to prepare it. (Paid or free doesn't matter)
  7. Noisy behavior within the facility, or other acts that cause trouble or discomfort to others.
  8. The loungewear and slippers provided in the room may be used outside the guest room.
  9. Other acts that impede safety and hygiene within the hotel.
